28- 不要只是删除视频——让法律先发声
我写下这些,是因为我认为,真相正在被掩盖。 我反对中国网络上对公共事件消息的封锁,反对让揭露暴力的影像消失,反对把追问的人当作麻烦。 这就是我保留这份记录的原因。 但我也必须说清楚:我的判断不能代替证据。对于网上被描述为发生在河北邢台的这起事件,我目前掌握的材料不足以还原完整经过,也不足以证明每一条相关消息是否被删除、由谁删除,以及为什么删除。 我不会为了反对掩盖,就把尚未核实的内容写成事实。 我没有能够独立核实的完整事件记录。 没有足以确认被打者伤情的可靠材料。 也没有能够确认最终处置结果的正式文件。 我不能代替警察、检察官或法院。 但如果流传的视频真实呈现了一个人倒在地上、头部遭到反复踢踹和踩踏,那么公众当然有理由追问:究竟发生了什么?这个人后来怎么样了?有关方面采取了什么措施? “私人纠纷”可以解释两个人为什么发生冲突,却不能回答暴力造成了什么后果,更不能代替对处理结果的说明。 认识对方,不会让伤害变得无关紧要。 双方存在感情关系,也不能让公众对暴力的担忧自动失去意义。 人们想知道的,并不复杂: 被打的人是否得到救助? 伤情是否经过检查? 警方是否受理、立案? 是否采取了拘留或其他措施? 原始视频和相关证据是否得到保存? 目前能够公开的处理进展是什么? 这些问题不该被当成制造麻烦。 我要求的,也不是把当事人的姓名、住址、完整病历和未经遮挡的影像全部公开。公众需要了解基本事实,当事人也需要隐私和尊严。这两件事应该同时得到尊重。 我希望监控、就医资料、证人证言、报警和出警记录都能被妥善保存,并在调查和处理过程中真正发挥作用。 证据可以不向所有人展示,但不能因此失去作用。 有些信息可以暂时不公开,但能够说明的部分,不应只剩下一句含糊的回应。 如果视频经过剪辑,就说明哪些片段缺失、哪些理解有误。 如果网上的伤情说法不实,就给出经过核实的基本情况。 如果已经依法处理,就说明采取了什么措施。 如果调查仍在进行,就说明目前进展,以及哪些内容暂时无法公开。 承认还有问题没有查清,比要求所有人停止追问更有说服力。 我最担心的,不只是一段视频消失。 我担心的是,人们逐渐接受这样一种规则:看到暴力,可以害怕,但不要说;发现疑点,可以怀疑,但不要问;一件事只要不再出现在屏幕上,就仿佛已经得到解决。 如果公共事件的消息被封锁,如果记录者因为保存和传播真实材料而受到压制,那么消失的就不只是内容,还有普通人参与公共生活的能力。 大多数人没有报社,没有电视台,也没有能够要求别人回答的权力。 他们往往只有一部手机、一双眼睛,以及一句请求: 请看一看。 请查清楚。 请告诉我们,这个人后来怎么样了。 这样的声音值得被认真对待。 当然,网络上会有谣言。视频可能缺少前因后果,转述可能夸大,情绪也可能跑在证据前面。 正因如此,事实才更需要被保存、核查和解释。 反对谣言,不应该成为回避问题的理由。 保护隐私,不应该成为拒绝一切基本说明的借口。 维护秩序,也不应该只表现为让讨论消失。 我反对用未经核实的指控审判一个人,也反对用“不要传谣”结束所有尚未得到回答的问题。 如果真相与最初流传的说法不同,就把不同之处讲清楚。 如果我的记录有错,我愿意更正。 但更正需要证据。 信任也需要证据。 我不是因为已经知道全部真相,才留下这份记录。恰恰是因为仍有关键问题无法核实,我才不愿意把它从记忆里删掉。 普通人会害怕,是因为倒在地上的人可能是自己的父母、孩子、朋友,也可能是自己。 暴力伤害当事人,也会让旁观者失去安全感。而当追问得不到回应、记录无法保留时,这种不安就很难消退。 我不是律师,不是记者,不是官员,也不是法官。 我能做的,是保存自己能够核实的材料,标明不能确认的部分,在得到新证据时修正记录。 不是为了仇恨。…
